The South American state of Ecuador (the Republic of Ecuador) does not participate in the Madrid Agreement Concerning the International Registration of Marks. Therefore, registration of trademark in this country is possible only in accordance with the Patent Cooperation Treaty, which is the basis of the PCT system, in which Ecuador is directly involved.

The possibilities of the foregoing system ensure cost-efficiency and simplicity of the procedure for submitting application to one Office.

The documents are verified for their completeness and compliance with the requirements for registration. Such verification is considered as formal examination, which certifies the availability of the application containing the following:

• Information about the applicant and his address;
• Description and qualitative image of the designation;
• List of classes according to the ICGS.

One copy of the application is mandatorily sent to the WIPO, and the other one is submitted to the International Search Authority. The applicant, who wishes to ascertain the trademark's protectability, also has the right to apply for the provision of International Preliminary Examination Services.

At the beginning of the national registration, the application is submitted, followed by examination concerning similarity with trademarks contained in the database of the Ecuadorian Institute of Intellectual Property (EIIP). The foregoing will contribute to the successful registration of the trademark in Ecuador.

If the comprehensive examination produced positive results, the trademark in Ecuador is published in the EIIP magazine. After the publication, third parties can file their objections or complaints within 30 days. If no objection has been received or rejected, a final decision on the registration of the trademark is made.

As a rule, the entire registration procedure takes from 6 months to one year. A certificate confirming your right to the trademark is valid for 10 years.
