Procedure for registering a brand name in Puerto Rico

  1. Before submitting application, the client should determine the visual or sound interpretation of his own trademark. In Puerto Rico, it is possible to register pictures, graphs, diagrams, mottos, notes, words, surnames and others as trademark. The main requirement is the absence of immoral elements in trademark, as well as its uniqueness and lack of similarity with the trademarks already registered in the country. The specialists of Law&Trust can carry out verification of the brand for compliance with the above requirement.
  2. Consultation. When you apply through chat, by phone or mail, the lawyer of the company answers all questions which concern the process of registration of trademark in Puerto Rico, terms and cost. The package of necessary documentation is also determined.
  3. Collection of documents. The client sends us a scan of his passport, power of attorney and application for the registration of trademark in Puerto Rico, the remaining documents are collected by the lawyer. The power of attorney gives him the right to represent your interests in the tax authority, during negotiations with shareholders and beneficial owners of your company.
  4. Processing of documents. Before being sent to the expert commission, the lawyer verifies the accuracy of filling out the forms, then the documentation is translated into English. They are sent to the representative office of Puerto Rico after subsequent revision.
  5. Consideration of the application by the expert commission. Members of the commission search for similar brands and verifies the documentation. In addition, information on new trademark is published, and it can be challenged by other persons. Disputes often  arise on the basis of the similarity of logos or if there are elements on the trademark that insult someone's feelings.
  6. Obtaining trademark. The term of validity of the trademark is 10 years from the moment of its approval by the expert commission. If the owner does not use trademark, then the validity of the mark may be canceled upon the decision of the representative office of Puerto Rico. Upon the expiry of 10 years, it is necessary to pay a state fee to renew the trademark.

You can clarify more detailed information regarding the procedure, as well as the list of documents and requirements for trademark in Puerto Rico during personal conversation with the lawyer. Communication is possible through online chat or online mail.
