Registration of trademark in Guatemala: stages and cost
Guatemala is not one of the countries which are parties to the Madrid Agreement and the Protocol, which means that only the national procedure for registration of trademarks is possible in the state. There are four provisions for registration of trademark, which should be taken into account when submitting an application, and they are the following:
- Entrepreneurs conducting activity in the territory of any of the countries under American jurisdiction submit applications according to the right of commercial use.
- Businessmen of the countries-participants of the Paris Convention can use foreign application. This union for the protection of intellectual property includes 174 countries around the world, which is why this procedure is most often used.
- If entrepreneur has company registered in any other state, he should apply for trademark registration under the system of foreign registration.
- Moreover, all natural persons and businessmen, whose corporations do not have branches in the territories of the countries of the two American continents, have the right to apply for the "intention-to-use" provision.

Guatemala: cost of registering a brand name

- Preliminary examination of the logo of trademark for compliance with the state regulations of Guatemala. In order for the emblem to be accepted and registered according to all rules, it should not include calls for extremism and offenses, include segments of immoral nature, consist of names or designations of popular figures or firms. It is forbidden to place the state symbols of the United States of America on the emblem.
- Collection of the full register of documents starting from the applicant's passport up to the statement of the turnover of the corporation and the data on turnover from its accounting department. - Preparation of the package of official documents for consideration by the Guatemalan expert commission, namely: translation of the forms into Spanish, verification of the forms concerning legal inconsistencies, and certification of each copy with seal and signature.
The issue is made one year after the filing of the documentation package for consideration. The validity of the permission for entrepreneurial activity is 10 years. In order to renew the permission for TM, it is necessary to pay fee and make application with check for payment to the Guatemalan representation office.
