Registration of trademarks in Latvia

Examination of trademark consists of formal verification of the imposed requirements, and therefore trademarks are not verified for their originality. Objections are accepted within 3 months after publication in the Official Register.

Trademark can be registered as international one, for example, in all the EU countries. In case of export of certain product, it is cost-effective to register trademark in the countries where the product will be sold.

Various designations are used as trademark, namely:

  • Graphic: images, pictures, symbols, color combinations;
  • Verbal: combinations of letters, figures, phrases;
  • Spatial: volume, form of goods;
  • Combined;
  • Sound or color signals.

Registered trademark in Latvia is valid for 10 years from the date of its registration with the patent office. After the expiry of the above period, it is possible to renew it for another 10 years.

Trademark can be registered by any legal entity, natural person, or several rightholders.

The Patent Office of Latvia may refuse to register trademarks, if their designations:

  • Are of immoral nature or misleading;
  • Describe the quality of good or service;
  • Are similar to the already well-known brands;
  • Affect copyright or commercial rights of other persons.
