Procedure of registering trademark in Argentina

The trademark is being registered in Argentina for the period of 10 years with the right of subsequent renewal. In case of positive decision, the period for legislative registration may reach 18 months. In order to start the procedure, the following package of documents should be prepared:

Argentina: Stages of trademark registration

  1. During the first 3 months, the Industrial Property Institute conducts formal examination of the submitted data and verifies their reliability.
  2. Then there should be publication of trademark in the Bulletin of Trademarks.
  3. The applications on protesting the registration of the right of ownership and from other market participants are accepted after the date of publication and within 30 days.
  4. Next, the examination proceedings is conducted, during which the uniqueness of the trademark and its compliance with the country's legislation shall be verified.
  5. After the positive results of verification, the certificate of registration is issued for 10 years.

Reasons for refusal of registering TM in Argentina

1. Names, words and signs have high degree of similarity with already registered brands;
2. Violation of legislation, ethical and moral aspects;
3. Graphic images or words of the trademark mislead the consumer about quality, form and purpose of the proposed product or service;
4. Words or images reserved by the state are used in whole or in part in the trademark;
5. There is no originality;
6. Personal data or name of natural person who has not consented to use his data are applied during the registration.
