Protection of the rights to the trademark is extremely relevant now. Registration of trademark gives its owner the right to use it and guarantees protection. The term during which the trademark in Chile goes through the entire registration process takes from four months to two years.

Numerical and word combinations, color and sound combinations, any graphic images, as well as means and styles of writing can obtain legal protection in Chile. At the same time, it is prohibited to register trademarks in the country:

  • Which contradict the public order of the state;
  • Images of state symbols;
  • Designations that are identical or similar to the trademarks in Chile filed for registration or already registered.

What is the procedure of registering a brand name in Chile?

Registration of trademark takes place in accordance with several stages:

1.Submission of the application;

2.Verification of compliance;

3.publication;

4.Substantive examination;

5.Payment of registration fee.

The application for registration is immediately filed with the patent office, and it undergoes formal verification for compliance with the requirements. After that, the information on trademark is published in the official bulletin. Certain period is set for raising claims, during which third parties have the right to file their objections.

If they were no objections, then the trademark is subject to substantive examination in the patent office. Only after the foregoing the registration fee is paid, and the trademark is considered as registered.

The validity of the trademark is 10 years with the possibility to renew it after the same period of time.
