Registration of trademark in Haiti

Trademark in Haiti is registered by filing an application. The Paris Convention regulations are in force in the country that helps protect new trademarks from plagiarism and copying of logos, but Haiti is not a member of the register of republics that are parties to the economic union under the Madrid Agreement.

The trademark registered according to the rules and legislation of Haiti provides the owner with the right to conduct business activity only within the country.

However, the existence of branch in the state under American jurisdiction allows to subsequently submit application for registration of the trademark in other territories of North and South Americas under the commercial use procedure that has a shorter period of consideration.

Procedure for registering a brand name in Haiti

1. Consultation and submission of the application. The counterparty applies to our company for obtaining detailed information on all stages of registration of trademark in Haiti. The application form is issued to the client by the lawyer, and the specialist should receive the completed application, copy of the counterparty's passport and power of attorney to represent his interests in various authorities when collecting official documents.

2. Verification of the trademark. Trademarks in Haiti should be expressed in graphic form and have full compliance with the state regulations. In addition to uniqueness, the commission will examine the emblem for the availability of immoral details, the contents of parts or sketches of US symbols, as well as the illegal use of names, surnames or quotations of famous persons.

The consideration takes no more than 12 months, after reconciliation of all documentation, the expert commission publishes data on the new trademark in the special register. Any person can challenge the registration in the presence of legal grounds. If there is no objection or they have been eliminated, the trademark is issued to the owner.

It is valid for 10 years, however, if it is not used, it may lose its legal validity.
