A trademark is legitimate in the territory of the state where it was registered. When a company enters the international arena, it is necessary to re-register the trademark in the country where the enterprise will carry out its activities.
Such a need is dictated by security considerations: the company has exclusive rights to the registered trademark, thus, the foregoing prohibits the possible use of this brand by another company.
Seychelles is an island state that is part of the Commonwealth of Nations. Foreign companies that are established on the islands are exempt from taxes, which makes the country attractive for world-class businessmen. Registration of trademark in the Seychelles is carried out under the Madrid Agreement, since the state is among the parties to the treaty.
Actions are carried out by means of legal representative from Law&Trust International. The first step towards registration of the trademark in the Seychelles is the consultation on the issues concerning protection of rights on trademark and other aspects of particular interest to the client.
After the theoretical issues are confirmed, the legal representative begins to prepare the documents. The client should provide the following information about the company:
Full name;
Bank details;
Data about the manager;
Graphic image of the trademark in electronic format;
Certificate of registration of the trademark in original counrty (or a copy of the application for registration).
Seychelles applies the ICGS (international classification of goods and services), therefore, in addition to the documents listed above, the data regarding the classes of goods and/or services that the client’s company produces and/or renders will be required. This simplifies and accelerates the trademark registration process.
After agreeing and verifying the information provided by the client, Law&Trust International compiles international application for registration of the trademark in the Seychelles. Submission of the application is carried out simultaneously with payment of the fee, the amount of which is set by the country of registration.
The total amount depends on the number of classes of goods and/or services. Further, the WIPO (World Intellectual Property Organization, and the Madrid system is under the auspices of the foregoing organization) verifies the trademark for uniqueness, after which it makes a decision. The time for consideration of the application is individual.
