Right to trademark in Gambia

Local businessman or non-resident entrepreneur can register trademark in the territory of Gambia. Filing of the application is possible only in accordance with the national procedure, since the state is not a party to any regional or international systems.

Before registration process, the designers of the counterparty shall create unique logo, and the emblem is not thoroughly verified on the similarity with the trademarks of other companies, but if the client takes a part of the details from competitors and registers the logo in other countries, he may be refused registration.

Natural persons applying for purchase of the trademark should prepare a minimum package of the following documents:

  1. Passport of the citizen of the country of residence. The copy should be colored, and all symbols shall be clearly visible. If the document does not specify the address of registration, an extract from the housing establishments is additionally required.

  2. Certificate from the place of work, extract from the bank about the availability of account and other forms confirming the material welfare of the applicant.

  3. Individual number of the taxpayer. It is often indicated in the passport, but it can be issued as separate form in some countries.

  4. Application for registration of trademark, filled out in English with standard or electronic signature.

The register of documents of legal entities is supplemented by the passports of all shareholders and beneficial owners, the charter of the company and the extracts from the protocol, the data from the tax authority and the Uniform Register of Entrepreneurs. By applying to Law&Trust, you obtain full list of documents, and our lawyers collect all necessary forms, translate and send them.

Permission for business activity is issued approximately one year after the sending of the package with the documents. During the indicated time, the commission verifies the correctness of the compilation of forms and publishes information on the new trademark. If there are no objections, trademark shall be successfully registered.
