Eritrea: registration of trademarks
One of the key components of the success of any business is a competently registered trademark. Only timely registration can reliably protect the rights of the owner. Each state has its own peculiarities in the registration procedure of the trademark.
Moreover, not all countries participate in the Madrid agreement or the Protocol to it. The foregoing obviously complicates the protection of trademark. One of such countries is Eritrea.
As in certain other countries that did not participate in signing of the Madrid Agreement, it is only possible to register trademark in Eritrea in the national patent office. Exactable registration fees depend on the number of classes that are being registered.
The term that takes the procedure for registration of trademark in Eritrea can range from six months to a year and a half.
Documents for registration of trademark in Eritrea
The application for trademark should contain detailed information about the applicant, as well as the following documents are required:
- description and image of the registered designation;
- a receipt for payment of the fee;
- list of classes of those goods and services for which this trademark is registered according to the ICGS.
Registration of trademark in Eritrea takes place in several stages. First, registration application is filed with the country's patent office, which is subject to formal verification on compliance with the requirements for it. Then information about the trademark is published in the official bulletin of the office.
Within a certain period, third parties may raise objections. If there are no objections, the trademark undergoes substantive examination in the patent office.
After its completion it is necessary to pay the registration fee, and the trademark is recognized as registered. The term of validity of protection of the trademark is 10 years with the possibility to renew it for the same period of time.
