Registration of trademarks in Poland
Any trademark is a kind of identity of product or service. It should be legally registered in accordance with international law. When producers enter the foreign market with their goods, they register their trademark, which reliably protects the goods from the infringement of unscrupulous competitors.
Businessmen from Eastern Europe and other regions are interested in registering trademark in Poland. This country is attractive one because registration of trademarks is possible in various ways, namely: national registration procedure, registration in the EU and international registration under the Madrid Protocol.
In Poland, as in other countries, the following are allowed to be trademark:
- black and white or color graphics;
- combinations of words, symbols and figures;
- combination of sounds and color scores;
- elements of holography, etc.
Registration of such designations that contain state symbols, generally accepted definitions, information contrary to moral principles and geographical names indicating the origin of the goods is not permitted.
National registration begins with submission of the package of documents to the Polish patent organization, which includes the application, description of the trademark, its graphic representation and receipt on payment of the state fee. Then, the application is considered by the experts and is published in the official publication in the absence of contradictions.
