Registration of trademark in Turkey
Foreign investors establish enterprises in the country frequently enough and think about registering trademark in Turkey. This decision is the most correct, because the product created as a result of persistent work should be provided with legal protection.
The Patent Institute is responsible for registration of trademarks in the territory of the Republic of Turkey. It grants the rights to the trademark valid in the territory of the country in the class in which it was applied for.
Registration of trademark in Turkey consists of several stages. During the preliminary examination, similar trademarks are searched for in the database of the Patent Institute. After that, the trademark is examined for its compliance with the necessary criteria.
This stage takes about 4-5 months, and upon its completion, official statement on its registration is issued, or on the refusal to register trademark in Turkey.
After the Patent Institute has approved the trademark, it is published in the Bulletin of the institution. If no applications are received from third parties within 3 months after the publication of the trademark, the Patent Institute makes decision to register the trademark for the applicant.
The owner pays the state fee, and the registration process is completed within 1-2 months. The Patent Institute issues the Certificate on Trademark Registration for him.
The trademark in Turkey is valid for 10 years from the date of submitting application for its registration. This period can be extended upon the condition that the registration is renewed every 10 years.
