Registration of trademarks in Portugal
Since the Portuguese Republic is a party to the Madrid Agreement Concerning the International Registration of Marks and the Protocol thereto, and is also a member of the EU, registration of trademark in Portugal is possible according to three methods:
- National procedure;
- Regional procedure according to which an application is submitted for single EU trademark;
- International procedure.
Each of these methods has strengths and weaknesses, so before you select one of them, it is necessary to determine exactly what you need. The most favorable is the registration of the EU trademark. If you make a choice in favor of this method, the filing of one application will allow you to register trademark not only in Portugal, but also in the territory of the states that are members of the EU.
For registering a brand name in Portugal according to the foregoing procedure, it is necessary to submit official application to the Office for Harmonization in the Internal Market, located in the Spanish city of Alicante. The trademark will be registered in the territory of all EU member countries immediately after entering it into the register of the Office for Harmonization of the Internal Market.
In addition, trademarks in Portugal can be registered in accordance with national and international procedure.
The following are subject to legal protection in Portugal:
- Any graphic images;
- Color and sound combinations;
- Numerical combinations and word combinations;
- Various slogans;
- Holograms, etc.
Determining the optimal method of registration is difficult, therefore, experienced specialists of Law&Trust International will help in assessing the specifics of each type of registration. They will collect the package of documents in accordance with the rules of the country of registration and international standards.
