Registration of trademarks in Romania
Lawyers of Law&Trust will help in registering a brand name in Romania. The procedure consists of the following stages:
- Submission of application for trademark registration from the applicant.
- Publication of the application in the BOPI bulletin of intellectual property within 7 days after filing the application.
- Examination of submitted documents, search of registered analogues within 6-9 months.
- Registration and issuance of the document that secures intellectual property rights for our client.
The issued certificate of trademark registration is valid for 10 years. If the applicant does not use the trademark for 5 years, the right assigned to him is revoked, and the registration certificate is automatically terminated.
In Romania, trademarks can be registered in the following forms:
- Word (denomination, slogan);
- Graphic (graphic elements without figures and letters);
- Combined (name combined with graphic image);
- Three-dimensional (three-dimensional picture that identifies product or service).
The maximum registration period in Romania according to the international procedure under the rules of the Madrid Agreement is 12 months. The Romanian government allows to specify multi-classes of services, goods that are related to the registered brand when registering.
In case of refusal in registration, the applicant has the right to submit substantive response in his favor, which is considered for up to 7 months.
