Trademark Registration in Kenya

Kenya is one of Africa's fastest-growing economies, known for its dynamic entrepreneurial sector and widespread digitalization. Strategically located in East Africa, it serves as a logistical, technological, and financial hub. Trademark registration in Kenya provides businesses—both local and foreign—with strong protection for their brands and helps secure their assets in an expanding market.

Who Needs a Trademark (TM) in Kenya?

It must be noted that this procedure is relevant not only for locally operating companies but also for those engaged in export and import. So, who will benefit from having a trademark?

    •  Export Companies. Kenya is a major hub for exports to East African, EU, and Middle Eastern markets. A registered trademark facilitates product entry into foreign markets, document processing, and customs clearance especially crucial for participation in international tenders or partnerships with global retail chains.

    • Importers and Distributors. A trademark strengthens legal standing in cases of copying or counterfeiting.

    • Companies in the Mining and Natural Resources Sector. Even for B2B models where goods are not sold to end consumers, a trademark is essential for legal company identification, concession agreements, contracts, and licensing. This is particularly relevant for foreign investors involved in resource extraction (gold, titanium, rare earth elements, etc.), where brand credibility directly affects reputation.

    • International Holdings. A trademark protects against “brand squatting” and provides a legal basis for franchising, rights transfers, licensing, and defense against bad-faith registrations.

Why Register a Trademark (TM) in Kenya?

A trademark grants exclusive rights to a name, logo, slogan, or other visual identifier, ensuring that no one else can use a similar mark. This is especially vital for international companies, where brand recognition directly influences sales and market perception abroad.

A registered TM enables effective protection against counterfeit and infringement. Kenya faces challenges related to unauthorized brand use. Without formal registration, a company has virtually no legal tools to protect its interests—neither in court, at customs, nor in commercial negotiations.

Moreover, a registered trademark becomes an intangible asset that can be licensed, sold, transferred, or used in investment transactions.

In African markets-where business practices may vary - formal registration is a signal of transparency and long-term commitment.

    Trademark Registration Procedure in Kenya

Trademark registration in Kenya is governed by the Trade Marks Act (Cap 506) and administered by the Kenya Industrial Property Institute (KIPI). The process adheres to international standards of intellectual property protection, including participation in the Madrid System.

    1. Application Preparation
The application may be filed by either a legal entity or an individual. The documentation must include identification papers, a description and image of the mark, and an indication of any priority claim. Foreign applicants must act through a licensed agent in Kenya and provide a notarized power of attorney.
    2. Formal Examination
KIPI reviews the application for completeness, correct formatting, and payment of required fees. If issues are found, a notice is issued requesting corrections.
    3. Substantive Examination
This phase evaluates the mark's distinctiveness and checks for conflicts with prior registered trademarks.
    4. Publication in the Official Industrial Property Journal
Upon passing examination, the mark is published. Within 60 days, any interested party may file an opposition. If an objection is filed, proceedings are initiated, which may last from several months to a year.
    5. Trademark registration
If no opposition is filed or objections are rejected, the application is approved, and a certificate of registration is issued. From that moment, the trademark receives full legal protection. The entire process takes approximately 18 months.

A Kenyan trademark is valid for 10 years from the date of filing and may be renewed for subsequent 10-year periods indefinitely.
