Who is entitled for obtaining trademark in Austria

Both natural person and operating company can apply to order trademark registration. Territorial location of the counterparty does not matter, but after issuing license for entrepreneurial activity, the client is required to establish business in Austria, since unused trademark can be canceled upon decision of an expert commission.

There are three means to submit request for all categories of applicants:

1. National procedure. Your application will be verified and have effect only in the territory of Austria. Standard package of documents is required, and the term of consideration of documents ranges from half a year in the absence of a queue.
2. Common trademark (CTM). Registration according to this procedure makes it possible to cover the entire territory of Europe. The client submits only one application, but TM will have effect in several dozen countries. There may be a delay in the terms of consideration, but the emerging opportunities cover this nuance.
3. International registration of the brand in accordance with the Madrid Protocol. It covers 97 countries around the world, including Austria. It is characterized by more strict procedure for verifying the client, his documentation and the logo for compliance with the regulations of all states that have signed the economic agreement.
