Registration of trademark in Kazakhstan
In the Republic of Kazakhstan, the foregoing procedure can be implemented by efforts of entrepreneur or organization. The owner of the registered trademark obtains the exclusive right to use the declared name in the territory of the country.
The issued certificate on registration of trademark in Kazakhstan will be relevant for 10 years. The procedure can take up to one year, depending on the queues and specifics of the region. Registration can be renewed as many times as necessary. According to the legislation, brands being registered can be upon record in letters, figures, pictures and other combinations of designations.
Trademark registration procedure in Kazakhstan
All applications pass through the Ministry of Justice of the Republic of Kazakhstan.The leading expert organization in the country is the National Institute of Intellectual Property.
- At the first stage, NIIP analyzes the existing trademarks in the State Register for repetition and plagiarism. The procedure requires the participation of patent attorneys and takes up to one month. In case of a decision regarding availability of similar trademark, the commission rejects the application.
- Next, the author needs to determine the list of services or goods that will be correlated with the brand, and they should correspond to the classic division according to the ICGS.
- The application is submitted with information about the applicant: name or full name, status, legal address, copy of the document on state registration. Copy of the certificate on assignment of the TRN and 15 images (80x80 mm) of the trademark with qualitative color transfer are also attached.
- For collective trademarks in Kazakhstan, it is required to attach specially compiled charter that determines the rules for applying the brand in all declared spheres.
